50 (1) For the purposes of this Act, the pension payable to a recipient under any of Parts I to III is the pension otherwise payable to the recipient thereunder, plus any amount by which that pension was, by Order in Council P.C. 77/8785 of the 26th day of September 1942 made under the War Measures Act, authorized to be augmented, which Order shall, for the purposes of this Act, be deemed to have been made under a provision of this section that, at the time when the Order was made, authorized the making thereof, and to have continued in effect thereafter, in respect of any service before the 31st day of March 1947 in respect of which such augmentation was authorized, notwithstanding the revocation of such Order on the 31st day of March 1947.

If a person receives a pension from more than one Member State, the amount of contributions deducted from all the pensions paid shall under no circumstances be greater than the amount deducted in respect of a person who receives the same amount of pension from the competent Member State.

2. Par dérogation au paragraphe 1, si, lors de la liquidation ou de la révision de prestations d’invalidité ou de pensions de vieillesse ou de survivant en application du titre III, chapitres 4 et 5, du règlement de base, l’institution d’un État membre a versé à une personne des prestations indues, cette institution peut demander à l’institution de tout autre État membre débitrice de prestations correspondantes en faveur de la personne concernée de retenir le montant payé en trop sur les arriérés que celle-ci verse à ladite personne.
2. By way of derogation from paragraph 1, if, when awarding or reviewing benefits in respect of invalidity benefits, old-age and survivors’ pensions pursuant to Chapter 4 and 5 of Title III of the basic Regulation, the institution of a Member State has paid to a person benefits of undue sum, that institution may request the institution of any other Member State responsible for the payment of corresponding benefits to the person concerned to deduct the amount overpaid from the arrears payable to the person concerned.

(2) For the purposes of the Public Service Pension Adjustment Act, a pension equal to the amount by which any pension otherwise payable to a recipient under any of Parts I to III was authorized as described in subsection (1) to be augmented shall be deemed to be payable to the recipient under this section, in the same manner, at the same time, for and in respect of the same period and subject to the same terms and conditions as the pension authorized to be augmented.

If, for a given year, a beneficiary does not declare all the agricultural areas, and the difference between the overall agricultural area declared in the payment claim on the one hand and the area declared plus the overall area of the agricultural parcels not declared, on the other, is more than 3 % of the area declared, the overall amount of aid under area-related measures payable to that beneficiary for that year shall be reduced by up to 3 % depending on the seriousness of the omission.

(c) a Member State which notifies to the Commission under Article 16(1)(a) an amount of at least 75 % of the financial allocation made to that Member State by Decision 2000/503/EC but less than the total of that financial allocation, may forward to the Commission, not later than 30 June, a request for subsequent financing of expenditure in the 2000-01 financial year in excess of the amount notified to the Commission under Article of 16(1)(a).
