50 (1) For the purposes of this Act, the pension payable to a recipient under any of Parts I to III is the pension otherwise payable to the recipient thereunder, plus any amount by which that pension was, by Order in Council P.C. 77/8785 of the 26th day of September 1942 made under the War Measures Act, authorized to be augmented, which Order shall, for the purposes of this Act, be deemed to have been made under a provision of this section that, at the time when the Order was made, authorized the making thereof, and to have continued in effect thereafter, in respect of any service before the 31st day of March 1947 in respect of which such augmentation was authorized, notwithstanding the revocation of such Order on the 31st day of March 1947.

8 (1) An increase shall be made pursuant to this Act in the annual rate of the pension payable to a recipient under the Civil Service Superannuation Act only where the pension is payable in respect of service in the Civil Service to the credit of the employee to or in respect of whom the pension is payable under that Act.

2. Aux fins de l’application du paragraphe 1, une personne est considérée assujettie au Régime de pensions du Canada au moment de son décès s’il survient au cours d’une année civile considérée comme une période admissible aux termes dudit Régime, relativement à ladite personne, ou si l’année civile antérieure à celle du décès était une période admissible aux termes dudit Régime relativement à ladite personne.
2. In the application of paragraph 1, a person shall be considered to have been subject to the Canada Pension Plan at the time of death if the death occurs during a calendar year which is a creditable period under that Plan in regard to the person concerned or if the calendar year immediately prior to the calendar year in which the death occurs was a creditable period under that Plan in regard to the person concerned.

Moreover, the Commission is also running the risk of this House adopting such a recommendation in the form of an own-initiative report, into which it would put something quite different to what the Commission, in its recommendation, has envisaged, and if that happens, the recommendation will be rendered worthless, for a recommendation is effective only if it can be taken as read that the legislator will be prepared, in subsequent proceedings, to support such a regulation, but if the legislator says ‘no’ to it, the recommendation is of no value.
