Mr. Speaker, I am conflicted somewhat as I begin my remarks today in that I object profoundly to the fact that this bill is designated S-7 instead of C-7, or whatever number it may get when it is introduced properly by the democratically elected members of Parliament in Canada's parliamentary system.

Article 54(1) and (2) of Directive 2004/39/EC of the European Parliament and of the Council of 21 April 2004 on markets in financial instruments amending Council Directives 85/611/EEC and 93/6/EEC and Directive 2000/12/EC of the European Parliament and of the Council and repealing Council Directive 93/22/EEC must be interpreted as meaning that, in administrative proceedings, a national supervisory authority may rely on the obligation to maintain professional secrecy against a person who, in a case not covered by criminal law and not in a civil or commercial proceeding, requests it to grant access to information concerning an investment firm which is in judicial liquidation, even where that firm’s main business model consisted in large scale fraud and wilful harming of investors’ interests and several executives of that firm have been sentenced to terms of imprisonment.

Catania une mention en première page des journaux italiens, mais je pensais que l’obligation de dire la vérité devant ce Parlement lui aurait imposé le même devoir qu’à moi-même: il faut se rappeler que le gouvernement de l’époque a formellement nié être au courant de l’affaire Abou Omar, ce qu’il a fait sans que la preuve du contraire ne soit apportée.
I think that this question, which I have answered several times before the Committee on Civil Liberties, Justice and Home Affairs, may well gain Mr Catania a mention in some headline in the Italian newspapers, but I would have thought that the obligation to tell the truth to this Parliament would have imposed on him the same duty as it does on me: to remember that the government at that time formally denied any knowledge of the Abu Omar case and did so without there being any proof to the contrary.

Progress has certainly been made by comparison with the previous Intergovernmental Conference, but the most worrying aspect is that the Council had on the table a proposal which would give the European Parliament a greater role, a proposal which would grant it a role similar to the one the Commission will have in these negotiations, and it did not approve this proposal. As we know, this is the fundamental problem, because it concerns the very nature of the European Parliament. This is not a parliament that functions within the normal constitutional systems of our countries.

La mission de ce comité n'aurait rien de futile ni de contrariant, puisqu'elle consisterait à préserver l'intégrité même du régime démocratique du Canada et la crédibilité du Parlement lui-même.
