The competent authority of the home Member State should also notify the issuer or the person responsible for drawing up the prospectus of the certificate of approval of the prospectus that is addressed to the authority of the host Member State in order to provide the issuer or the person responsible for drawing up the prospectus with certainty as to whether and when a notification has in fact been made.

Si une personne n’a pas droit à une prestation de l’Irlande aux termes de la seule législation de l’Irlande et si les dispositions du présent Accord relatives à la totalisation sont invoquées, le droit de la personne à la prestation est déterminé par l’autorité compétente de l’Irlande selon la base des périodes totalisées conformément aux conditions de cotisations statutaires prévues aux termes de la législation de l’Irlande et ladite autorité compétente détermine le montant de la prestation de l’Irlande, sauf la prestation de décès et l’allocation d’orphelin à caractère contributif conformément à la formule suivante :

If a person is not entitled to an Irish benefit under the legislation of Ireland alone and the totalisation provisions of this Agreement are invoked, the person’s entitlement to benefit shall be determined by the competent authority of Ireland on the basis of the totalised periods in accordance with the relevant statutory contribution conditions provided for under the legislation of Ireland and the aforesaid competent authority shall calculate the amount of Irish benefit, other than death grant and orphan’s (contributory) allowance in accordance with the following formula:

Si, après l’entrée en vigueur de l’ancien Accord, mais avant l’entrée en vigueur du présent Accord, une personne a présenté une demande de prestation aux termes de la législation d’une Partie, et que, au jour de l’entrée en vigueur du présent Accord, l’institution compétente de ladite Partie n’a pas statué sur la demande, l’institution compétente applique les dispositions de l’ancien Accord afin de déterminer le droit de ladite personne à ladite prestation.
2. If, after the date of entry into force of the previous Agreement but before the date of entry into force of this Agreement, a person submits an application for a benefit under the legislation of a Party, and if, on the date of entry into force of this Agreement, the competent institution of that Party has not yet reached a decision on that application, that competent institution shall apply the provisions of the previous Agreement when determining that person’s entitlement to that benefit.

5. L’autorité compétente qui adopte une mesure de protection comportant une ou plusieurs des interdictions ou restrictions visées à l’article 5 informe la personne bénéficiant de ladite mesure, par tout moyen approprié conformément aux procédures prévues par le droit national de l’État dont elle relève, de la possibilité de demander qu’une décision de protection européenne soit émise au cas où ladite personne déciderait de se rendre dans un autre État membre ainsi que des conditions de base d’une telle demande.
5. When a competent authority adopts a protection measure containing one or more of the prohibitions or restrictions referred to in Article 5, it shall inform the protected person in an appropriate way, in accordance with the procedures under its national law, about the possibility of requesting a European protection order in the case that that person decides to leave for another Member State, as well as of the basic conditions for such a request.

Where the issuing State considers it necessary in view of the sentenced person’s age or his or her physical or mental condition, that opportunity shall be given to his or her legal representative.

2. If a person receives benefits under the legislation of one Member State in respect of an injury resulting from events occurring in another Member State, the provisions of the said legislation which determine the cases in which the civil liability of employers or of their employees is to be excluded shall apply with regard to the said person or to the competent institution.
