5. demande une commission d'enquête internationale indépendante sur les incidents qui ont causé des morts et des blessés et qui ont donné lieu à des incarcérations pendant les événements qui se sont produits en Libye depuis le 15 février; souligne que la responsabilité pénale individuelle des auteurs des attaques contre des civils est engagée au titre du droit international, qu'ils doivent être traduits en justice et qu'il ne peut y avoir d'impunité; se réjouit, à cet égard, que la Cour pénale internationale ait été saisie de la situation en Libye par le Conseil de sécurité des Nations unies et demande aux États membres de coopérer avec la Cour et son procureur pour que justice puisse être faite rapidement;

Calls for an independent international inquiry committee into the incidents leading to death, injuries and imprisonments during the events that have occurred in Libya since February 15; Underlines that the perpetrators of the attacks against civilians incur individual criminal responsibility under international law, that they must be brought to justice and that there can be no impunity; welcomes, in this respect, the referral of the situation in Libya to the International Criminal Court by the UNSC and calls on the Member States to cooperate with the Court and its Prosecutor so that justice can be done swiftly;

Points out that, according to information given by Murat Kurnaz's lawyer and information provided by the German authorities, there was a prospect of the release of Murat Kurnaz from Guantánamo in 2002 but this was not accepted by the German authorities; notes that on many occasions since 2002, Murat Kurnaz's lawyer was told by the German Government that it was impossible to open negotiations with the US Government on his release because Murat Kurnaz was a Turkish citizen; notes that according to information available to the Temporary Committee as early as at the end of October 2002, Murat Kurnaz posed no terrorist threat; expects a full clarification of all relevant actions or failures to act on the part of the German authorities by the German Parliament inquiry committee and welcomes the fact that those inquiries have already begun;

[79] The obligation to conduct investigations continuously over a period which must be proportionate to the circumstances and complexity of the case, imposed by Article 6(5) of Regulations (EC) No 1073/1999 and (Euratom) No 1074/1999, is connected with the obligation to inform the Supervisory Committee of the reasons for which it has not yet been possible to wind up the investigation, and of the expected time for completion, where a case drags on for longer than nine months (Article 11(7)).
