This includes also a comprehensive set of preventive instruments, concerning controlling, auditing and reporting, early warning and fraud-proofing [14]. However, more effective means are also needed to fight criminal activities against the EU budget.

The Commission shall take appropriate measures to ensure that, when activities financed under this Regulation are implemented, the financial interests of the Union are protected through the application of preventive measures against fraud, corruption and any other illegal activities, through effective checks and, if irregularities are detected, through the recovery of the amounts wrongly paid and, where appropriate, effective, proportionate and deterrent penalties.

The last Commission Anti-Fraud Strategy was adopted in 2000[19] and the ensuing Action Plans for 2001-2003 and 2004-2005 created a basis for a comprehensive EU policy against fraud.[20] The Commission reported on the implementation of the Action Plan and on progress in the development of anti-fraud policies in its annual reports on the protection of the financial interests of the Communities and the fight against fraud from 2001 to 2005.[21] In 2007, the Commission adopted a Communication on fraud-proofing[22] together with a Communication on the division of responsibilities between OLAF and the Commission Services for expenditure under shared management, whereby the Services assumed responsibility for financial follow-up of irregularities and fraud.[23] The implementation of these Communications shows that OLAF’s know-how, drawn from its investigative experience, can provide valuable input into the Commission.

The Commission will report on its fraud-proofing activities through the Commission’s annual report on the fight against fraud, published under Article 280 of the Treaty.

The purpose of the 2001 communication on fraud-proofing was to achieve the objectives of the White Paper on reform and of the Commission communication on the overall strategic approach to fighting fraud. Those objectives were to develop a culture of prevention and to strengthen the capacity of the basic legal instruments to withstand fraud or any other illegal activity.
