Sa Majesté la Reine, la Cour d'appel du Québec a reconnu, comme on l'a fait dans toutes les autres décisions rendues jusque-là, qu'en vertu de la Loi sur les mesures de guerre et la Constitution telle qu'elle existait alors, aucun contrôle judiciaire n'était possible en ce qui a trait à la preuve à l'appui de la décision prise par le gouverneur en conseil de déclarer qu'un état d'insurrection était appréhendé.
In Gagnon and Vallières vs. Regina, the Quebec Court of Appeal found, as had all court decisions up to then, that, under the War Measures Act and the constitution as it existed at the time, no judicial control could be exercised over the evidence in support of the decision by the governor in council to declare that a state of insurrection was feared.
