- La seconde consiste à prévoir un délai de prescription de cinq ans pour le recouvrement des créances communautaires -ce délai pouvant éventuellement être prolongé en cas de poursuites actives en vue du recouvrement: à l'heure actuelle, il n'y pas de délai général de prescription "communautaire" ( il y a un délai dans certains règlements sectoriels, par exemple en ce qui concerne le statut: 5 ans, le règlement PIF, protection des intérêts financiers: 4 ans, mais il y a interférence avec les droits nationaux applicables, car le contrat fait référence à ce droit national ou parce que le juge saisi est un juge national qui applique sa propre loi comme loi de procédure. Ceci aboutit à une cacophonie épouvantable dans certains États membres où la créance des institutions est prescrite après 3 ou 10 ans, ou encore l'on est simplement maintenue dans l'ignorance quant à savoir si la créance est prescrite, avant d'en saisir le juge. - The second proposal is that there should be a five-year time-bar on the recovery of sums owed to the Community. This limit could be extended in cases where active steps are being taken to secure recovery. As things stand, there is no general time-limit of a ‘Community’ nature (such a limit exists in certain sectoral regulations e.g. those concerning the Staff Regulations: 5 years, the regulation on the protection of the communities’ financial interests: 4 years). However, there is interference with the national legislation, where the contract refers to national law or where the judge is a national one applying his own law as the law of procedure. This could give rise to total chaos in those Member States where institutions’ right to collect debts is time-barred (after 3 or 10 years), or where, quite simply, no information is given on whether the deadline has lapsed until the case comes before the judge. Nor is it clear whether after the period has elapsed it is possible to accept compensation or spontaneous payment by the debtor. In brief, this proposal would introduce legal certainty for both the institutions and the debtors.

3. En vue de maintenir un niveau élevé de protection de la santé humaine et de l'environnement, le rapport visé au paragraphe 1 est accompagné, le cas échéant, de propositions visant à modifier la présente directive et pouvant prévoir notamment des prolongations supplémentaires du calendrier de réalisation de la valeur limite du benzène visée à l'annexe I, qui peuvent être accordées en application de l'article 3, paragraphe 2.
3. With a view to maintaining a high level of protection of human health and the environment, the report referred to in paragraph 1 shall be accompanied, if appropriate, by proposals for the amendment of this Directive which could include further extensions to the timetable for meeting the limit value for benzene in Annex I which may be agreed under Article 3(2).

In order to offset these omissions, the proposal aims to stipulate that Commission and Member State experts should have the possibility of carrying out inspections not only within the Community but also in third countries, particularly following the emergence of a phenomenon likely to have an adverse effect on the fitness for consumption of animal feeding stuffs marketed within the Community; that a safeguard procedure should be set up and that the Commission should have the opportunity, if necessary, to assign Community experts to the site in order to check whether Community regulations are being observed and to take any appropriate measures necessary; that the Commission should be responsible for adopting specific coordinated inspection programmes, in addition to the general programmes already stipulated by Directive 95/53/EC, in the event of unexpected contamination which may represent an imminent and serious risk to human and animal health.

Jim Hart (Okanagan-Similkameen-Merritt, Réf.): Monsieur le Président, les électeurs de ma circonscription, celle d'Okanagan-Similkameen-Merritt, demandent au Parlement de rejeter toute proposition pouvant rendre plus restrictive la réglementation actuelle sur les armes à feu, de respecter l'intégrité des propriétaires d'armes à feu responsables et respectueux des lois et d'amener le gouvernement du Canada à prendre les mesures nécessaires pour appliquer rigoureusement les lois régissant actuellement l'utilisation d'une arme à feu dans la perpétration d'un crime, en insistant notamment sur l'application rigoureuse de l'article 85 du Code criminel, à formuler des lignes directrices strictes sur la détermination de la peine et à prévoir des peines obligatoires à l'intention de quiconque est trouvé coupable de posséder ou d'avoir utilisé une arme à feu pour perpétrer un crime avec violence ou menace de violence.
Mr. Jim Hart (Okanagan-Similkameen-Merritt, Ref.): Mr. Speaker, my constituents from Okanagan-Similkameen-Merritt call on Parliament to reject any proposals which might add to the existing regulatory restrictions regarding firearms; to respect the integrity of law-abiding, responsible firearms owners; to cause the Government of Canada to take such measures as are necessary to provide for strict enforcement of existing statutes governing the use of firearms in the commission of a criminal offence, with particular emphasis on the rigorous use of section 85 of the Criminal Code; and to provide strict sentencing guidelines and mandatory sentences for anyone convicted of the use or possession of a firearm in the commission of a crime in which violence is threatened or actually used.
