il faudrait insérer une référence explicite à la législation européenne applicable en matière de protection des données dans les deux propositions, au moyen d’une disposition de fond y consacrée qui mentionnerait en particulier la directive 95/46/CE et les législations nationales mettant en œuvre cette dernière, ainsi que le règlement (CE) no 45/2001 s’agissant du traitement des données à caractère personnel par les institutions et les organes de l’Union européenne. Cette disposition devrait aussi indiquer explicitement que les propositions sont sans préjudice de la législation applicable en matière de protection des données. La référence à la décision-cadre 2008/977/JAI du Conseil, du 27 novembre 2008, faite au considérant 33 devrait être supprimée;
an explicit reference to applicable EU data protection law should be inserted in both Proposals in a substantive and dedicated provision, mentioning in particular Directive 95/46/EC and the national laws implementing Directive 95/46/EC, and Regulation (EC) No 45/2001 as concerns the processing of personal data by EU institutions and bodies; this provision should also clearly state that the Proposals are without prejudice to the applicable data protection laws; the reference in recital 33 to Council Framework Decision 2008/977/JHA of 27 November 2008 should be deleted;

«2 bis. ‘2a. The competent institution may not refuse to grant the authorisation provided for in Article 20(1) to a person who has sustained an accident at work or who has contracted an occupational disease and who is entitled to benefits chargeable to that institution, where the treatment appropriate to his/her condition cannot be given in the Member State in which he/she resides within a time-limit which is medically justifiable, taking into account his/her current state of health and the probable course of the illness’.
