The third paragraph of point 4 of the Protocol states quite clearly that: "Any decision to abolish or amend this quota* shall be taken by the Council, acting by a qualified majority on a proposal from the Commission" (*In other words, the zero-duty quota allowed to Germany.) As for the compatibility of the Council decision with the GATT, there are two points to make: (i) The present banana regime is already the subject of a GATT panel; it is therefore wrong to claim that the difficulties within GATT have arisen as a result of the new Regulation (ii) The tariffication proposed under the new arrangements actually improves our position with respect to GATT since it is in line with the general philosophy of the Uruguay Round.
