In paragraphs 39 to 44 of the judgment under appeal, the General Court nevertheless considered the Council’s argument that that institution was justified in communicating the new incriminating evidence against the PMOI at the same time as the contested decision was adopted and not before, despite the fact that it was not an initial decision to freeze funds, because of the particular situation in which the Council found itself in that case, more specifically, the urgency with which the contested decision had to be adopted.
