But there are limits to the effectiveness of national action. Gaps are left which only the EU can fill. In order to reach its objectives, from the very outset the Treaty assigned a central role to fully-fledged common policies such as competition, trade, transport, agriculture and fisheries, and more recently EMU. There cannot be a true internal market and a customs union without precise rules to establish a level playing field. Without harmonising the great diversity of Member State policies, internal border controls would have had to be maintained, the EU could not have spoken with one voice in international trade and sustainability would have suffered in a downward spiral of negative competition.

When we think about the justice gap, and as I said before I think that is what you are doing on this committee, we need to understand that section 278, properly and fully applied, could play a really important role in narrowing the justice gap and in preventing these courtroom rituals of degradation that Taslitz identifies.
Cette lacune de la justice que je viens d'évoquer constitue selon moi l'essentiel du mandat confié à votre comité. Or, il nous faut comprendre que l'article 278, s'il en était fait une application correcte, pourrait beaucoup contribuer à la combler et à faire disparaître ces rituels judiciaires de dégradation dont parle le professeur Taslitz.
