(15) For contracts and concessions with an estimated value equal or above EUR 5 000 000 the Commission should approve the intended exclusion if the international agreement concerning market access in the field of public procurement and concessions between the Union and the country where the goods and/or services originate contains, for the goods and/or services for which the exclusion is proposed, explicit market access reservations taken by the Union.

Measures must be taken to ensure that airports do not discriminate among individual airlines, granting preferential treatment and concluding with airlines individual agreements and business contracts which provide for exceptions, and to ensure that airlines cannot obtain larger volumes of services, thus securing for themselves advantages and commercial concessions in a way which is not open and transparent, which excludes others and is not open to others, and by concluding individual, non-public contracts.

Sport has a social function and plays a role as an integral part of the culture of the Community countries, as well as having educational, social, cultural and recreational aspects recognised in the Amsterdam Treaty. It is necessary to bear in mind the way sport is organised in Europe, its characteristics and recent developments. A distinction is made in the Member States between professional sport (organised by businesses) and amateur sport (organised by non-profit-making organisations). Amateur sport, as practised in the Member States, must be recognised as such by the various national sports federations, in accordance with the standards drawn up by those organisations and in compliance with the directives drawn up by the various national Olympic committees in the Member States.
