Must Article 63(1) TFEU, read in conjunction with Article 65 TFEU, be interpreted as precluding legislation of a Member State which provides that, for the calculation of gift tax, the allowance to be set against the taxable value in the case of a gift of real property situated in that Member State is lower in the case where the donor and the recipient had their place of residence in another Member State on the date of execution of the gift than the allowance which would have been applicable if at least one of them had had his or her place of residence in the former Member State on that date, even if other legislation of the Member State provides that, on the application of the recipient of the gift, the higher allowance is to be applied, on condition that account is taken of all assets transferred gratuitously by the donor ten years prior to and within ten years following the date of execution of the gift?

Aux fins de l'exécution des obligations établies par la directive 96/71/CE, et notamment son article 6, et par la présente directive, les États membres veillent à disposer de mécanismes efficaces permettant à un travailleur détaché de porter plainte directement contre son employeur et d'engager une procédure judiciaire ou administrative, également dans l'État membre sur le territoire duquel le travailleur est ou a été détaché, lorsque ce dernier considère avoir subi une perte ou un préjudice du fait du non-respect des règles applicables, et ceci même après le terme de la relation dans le cadre de laquelle le manquement est censé avoir eu lieu.

For the enforcement of the obligations under Directive 96/71/EC, in particular Article 6 thereof, and this Directive, Member States shall ensure that there are effective mechanisms for posted workers to lodge complaints against their employers directly, as well as the right to institute judicial or administrative proceedings, also in the Member State in whose territory the workers are or were posted, where such workers consider they have sustained loss or damage as a result of a failure to apply the applicable rules, even after the relationship in which the failure is alleged to have occurred has ended.

17. invite le Conseil et la Commission à poursuivre leurs efforts vigoureux pour promouvoir la ratification universelle du Statut de Rome et l'adoption des dispositions législatives d'application nécessaires au niveau national, conformément à la position commune 2003/444/PESC du 16 juin 2003 concernant la Cour pénale internationale et au Plan d'action de 2004 pour assurer le suivi de la position commune; demande que ces efforts aboutissent à la ratification et à la mise en œuvre de l'accord sur les privilèges et les immunités de la CPI, qui est un outil opérationnel important pour la Cour; accueille avec satisfaction les récentes ratifications du Statut de Rome par Madagascar, les îles Cook et le Suriname en 2008, qui portent à 108 le nombre total des États parties en juillet 2008; invite la République tchèque, dernier État membre de l'Union à ne pas avoir ratifié le statut de Rome, à enfin remédier sans plus tarder à cette situation ; invite instamment la Roumanie à abroger l'accord bilatéral d'immunité qui la lie aux États-Unis d'Amérique;

Calls on the Council and the Commission to continue their vigorous efforts to promote universal ratification of the Rome Statute and national implementing legislation, in conformity with Council Common Position 2003/444/CFSP of 16 June 2003 on the International Criminal Court and the 2004 Action Plan to follow-up on the Common Position; requests that such efforts be extended to include ratification and implementation of the Agreement on the Privileges and Immunities of the ICC, which is an important operational tool for the ICC; welcomes the fact that the ratifications of the Rome Statute by Madagascar, the Cook Islands and Suriname in 2008 brought the total number of States Parties to 108 in July 2008; demands that the Czech Republic, as the only remaining EU Member State not to have ratified the Rome Statute, finally do so without further delay ; urges Romania to rescind its Bilateral Immunity Agreement with the United States;

25. With regard to the state of play of the ratification process of the Accession Convention to the Arbitration Convention[7], at the end of September 2006, twelve Member States had ratified it and the other Member States had indicated that the Convention should be ratified in the coming months.

3. If the effect of applying paragraph 1 would be to relieve all the institutions of the Member States concerned of their obligations, benefits shall be provided exclusively under the legislation of the last of those Member States whose conditions are satisfied, as if all the periods of insurance and residence completed and taken into account in accordance with Articles 6 and 51(1) and (2) had been completed under the legislation of that Member State.

La présente convention entrera en vigueur, dans les rapports entres les États qui l'auront ratifiée, le premier jour du troisième mois suivant le dépôt du dernier instrument de ratification par les États membres originaires de la Communauté et un nouvel État membre.
This Convention shall enter into force, as between the States which shall have ratified it, on the first day of the third month following the deposit of the last instrument of ratification by the original Member States of the Community and one new Member State.
