En conséquence, la Commission a adressé une lettre de mise en demeure à l'Italie, et comme celle-ci est restée sans réponse, elle a décidé d'envoyer un avis motivé (deuxième lettre d'avertissement). Germany answered the Letter of Formal Notice (first warning letter) by informing the Commission that implementing legislation was being prepared. Since the draft legislation has still not been adopted and the timetable set up by the German authorities has not been respected, the Commission decided to send a Reasoned Opinion.
