Premièrement, en ce qui concerne la base juridique, nous en sommes arrivés à la conclusion que l’article 179 était une base insuffisante et que nous avions besoin d’une base juridique qui comprenne à la fois la coopération avec les pays en développement et celle avec les pays industrialisés, autrement dit, de l’article 181 bis. Firstly, in relation to the legal base, we took the view that Article 179 was an insufficient base and that we needed a legal base that included cooperation with both developing and industrialised countries: in other words the inclusion of Article 181a. Nevertheless, we respect the view of the Committee on Development that having this in a single instrument involved the risk of vulnerability between development objectives and industrial objectives.

From a legal and technical point of view, it is almost an abuse of parliamentary procedure: it mentions facts and people often out of context, without any evidence to support the serious allegations it makes; it uses third parties as reliable sources of information without having gone through the proper procedure for assigning the task, according to the Rules of Procedure; it makes critical assessments of countries that have yet to become active members of our institution without any supporting evidence; it does not take adequate account of the assessments made by the competent committees asked to give an opinion; it violates a basic criterion of our legal activity – subsidiarity – particularly regarding legislation; it even censures national parliaments; and I could go on down a long list.
