In order to tackle a widespread problem in sea transport, namely the worrying increase in illegal operational discharges of ship-source polluting substances, in 2003 the Commission submitted a proposal for a directive based on Article 80(2) (transport) of the EC Treaty which states that ‘The Council may, acting by a qualified majority, decide whether, to what extent and by what procedure appropriate provisions may be laid down for sea and air transport’.

3. If, on 1 January 2006, the requirements for entry into force under paragraph 1 or paragraph 2 of this Article have not been met, the depositary shall invite those governments which have signed this Agreement definitively or have ratified, accepted or approved it, or have notified that they will apply this Agreement provisionally, to decide whether to bring this Agreement into force definitively or provisionally among themselves, in whole or in part, on such date as they may determine.

6. It may be agreed, in technical arrangements made between the Commission and the competent bodies in certain third countries and approved in accordance with the procedure referred to in Article 18(2), that activities referred to in Article 13(1)(i) may also be carried out under the authority of the Commission and in accordance with the relevant provisions of Article 21 in the consignor third country, in cooperation with the official plant protection organisation of that country.

Aside from Article 80(2) (ex Article 84) of the Treaty, which provides that the Council, acting by qualified majority, may lay down appropriate provisions for sea transport, for the purposes of this opinion the following are of particular interest: the legal reforms in connection with the transfer of ships from one register to another within the Community (Regulation (EEC) No 613/91), controls on ships calling at Community ports (Directive 95/21/EC), ship inspection organisations (Directive 94/57/EC), training for seafarers (Directive 94/58/EC) and, in general, with the free provision of services in the sea transport sector (Regulation No. 3557/92).
