36. applaudit l'accord conclu entre le Sénégal et l'Union africaine visant à créer un tribunal spécial pour poursuivre l'ancien président du Tchad Hissène Habré pour crimes de guerre, torture et crimes contre l'humanité, ainsi que l'accord conclu entre les gouvernements du Sénégal et du Tchad permettant aux juges sénégalais d'effectuer des enquêtes au Tchad; encourage fortement les responsables politiques des différents pays de la région tout comme l'ensemble des autorités publiques à préciser et mettre en œuvre rapidement leur volonté de mettre fin à la culture de l'impunité des personnes accusées de crimes de guerre et des auteurs présumés de violations des droits de l'homme au Tchad et dans le reste de la région; observe à cet égard que le Tchad est le seul pays du Sahel à ne pas encore avoir adhéré au protocole de la charte africaine des droits de l'homme et des peuples portant création d'une Cour africaine des droits de l'homme et des peuples; encourage le Tchad à y remédier, afin d'envoyer un message fort témoignant de sa volonté de punir les atteintes systémiques aux droits de l'homme et apporter réparation aux victimes; déplore également la loi récemment adoptée au Burkina Faso accordant une amnistie aux chefs d'État; craint que cela n'envoie un mauvais signal aux auteurs de violations des droits de l'homme dans la région et n'aille à l'encontre de l'esprit de la lutte contre l'impunité;
36. Applauds the agreement between Senegal and the AU to establish a Special Tribunal to prosecute former Chadian President Hissène Habré for war crimes, torture and crimes against humanity, and the agreement between the governments of Senegal and Chad to allow Senegalese judges to conduct investigations in Chad; encourages strongly political leaders in the Sahel countries and all public authorities to explicate and give swift effect to their resolve to end the culture of impunity for alleged war criminals and human rights violators in Chad and elsewhere in the region; notes, in this connection, that Chad remains the only Sahel country not to have signed up to the Protocol to the African Charter on Human and Peoples’ Rights on the Establishment of an African Court on Human and Peoples’ Rights; encourages Chad to do so, as a strong signal of its commitment to punishing systemic abuses of human rights and providing redress to victims; regrets, moreover, Burkina Faso’s recent law granting amnesty to heads of state; fears that this sends the wrong signal to violators of human rights in the region and runs counter to the spirit of tackling impunity;
