3. salue le rôle responsable joué par la Verkhovna Rada, le parlement ukrainien, qui a assumé pleinement ses responsabilités constitutionnelles en comblant le vide politique et institutionnel créé par la démission du gouvernement et la destitution du président, et est convaincu que le mouvement Euromaidan jouera son rôle dans le processus politique futur en Ukraine; prend acte des mesures adoptées jusqu'à présent par le parlement en ce qui concerne, notamment, le retour à la Constitution de 2004, la décision d'organiser des élections présidentielles le 25 mai 2014, la décision de retirer les forces de police et de sécurité et la libération de l'ancienne première ministre Ioulia Timochenko; réclame la formation d'un gouvernement d'unité nationale qui soit le plus large possible afin de répondre aux besoins urgents du pays;

Welcomes the responsible role played by the Verkhovna Rada in assuming its full constitutional functions and filling the political and institutional vacuum created by the resignation of the government and the dismissal of the President, and is convinced that the Euromaidan movement will play its role in the future political process in Ukraine; takes note of the measures adopted so far by the parliament with regard, in particular, to the return to the 2004 Constitution, the decision to hold presidential elections on 25 May 2014, the decision to withdraw police and security forces and the release from prison of former Prime Minister Yulia Tymoshenko; calls for the formation of a national unity government that is as inclusive as possible in order to address the urgent needs of the country;

7. demande aux autorités ukrainiennes de garantir l'impartialité et la transparence du jugement en cassation de l'affaire concernant M Timochenko, qui doit être conforme aux normes et pratiques juridiques d'équité et de justice communes en Europe; exige la fin du recours à une justice sélective ciblant les opposants politiques ou autres; déplore que la Haute Cour d'Ukraine spécialisée dans les affaires civiles et pénales ait reporté son arrêt sur le recours en cassation de la décision du tribunal de l'arrondissement de Petchersk à Kiev dans l'affaire Timochenko; prend acte de l'ajournement au 26 juin 2012 de l'audience de cassation consacrée à l'affaire Ioulia Timochenko; juge ce retard regrettable et met en garde contre toute décision de différer une procédure judiciaire régulière;
7. Calls on the Ukrainian authorities to guarantee the impartiality and transparency of the cassation process in Ms Tymoshenko's case, which should take place in line with the fair and just legal standards and practices common in Europe, and demands an end to the use of selective justice targeting political and other opponents; deplores the fact that the High Specialised Court of Ukraine on Criminal and Civil Cases has postponed its ruling on the cassation appeal in Ms Tymoshenko's case against the decision of Pechersk District Court in Kyiv; notes the adjournment of the cassation hearing on the case of Yulia Tymoshenko to 26 June 2012, considers this delay regrettable, and warns against protraction of due legal process;

3. demande instamment aux autorités ukrainiennes d'assurer un procès équitable, transparent et impartial dans le cas où Ioulia Timochenko ferait appel de la sentence prononcée, ainsi que dans les autres actions intentées contre des membres de l'ancien gouvernement; insiste pour qu'Ioulia Timochenko puisse exercer son droit à participer pleinement au processus politique dès maintenant comme lors des prochaines élections en Ukraine;
3. Urges the Ukrainian authorities to ensure a fair, transparent and impartial legal process should Yulia Tymoshenko appeal against her conviction, and in the other trials against members of the former government; insists that Yulia Tymoshenko should be allowed to exercise her right to participate fully in the political process both as of now and in the forthcoming elections in Ukraine;

F. considérant que, dans son discours du 12 octobre 2011 devant le Parlement européen sur la situation en Ukraine, la haute représentante Catherine Ashton a souligné que les poursuites à l'encontre de Ioulia Timochenko étaient motivés par des raisons politiques et que sa condamnation faisait suite à un procès qui n'avait manifestement pas respecté les normes internationales en matière de procédures équitables, transparentes et indépendantes;
F. whereas in her speech before the European Parliament on the situation in Ukraine on 12 October 2011, High Representative Catherine Ashton underlined that the prosecution of Yulia Tymoshenko was politically motivated and that her conviction followed a trial which clearly did not respect international standards as regards a fair, transparent and independent legal process;
