(20) Afin de surmonter les difficultés pratiques existantes pour l'obtention des informations sur la localisation du compte bancaire du débiteur dans un contexte transfrontière, il importe que le présent règlement établisse un mécanisme permettant au créancier de demander que les informations nécessaires pour identifier le compte du débiteur soient obtenues par la juridiction, avant la délivrance de l'ordonnance de saisie conservatoire, auprès de l'autorité chargée de l'obtention d'informations désignée de l'État membre dans lequel le créancier croit que le débiteur détient un compte.
(20) In order to overcome existing practical difficulties in obtaining information about the whereabouts of the debtor's bank account in a cross-border context, this Regulation should set out a mechanism allowing the creditor to request that the information needed to identify the debtor’s account be obtained by the court, before a Preservation Order is issued, from the designated information authority of the Member State in which the creditor believes that the debtor holds an account.

Where the creditor has obtained in a Member State an enforceable judgment, court settlement or authentic instrument which requires the debtor to pay the creditor’s claim and the creditor has reasons to believe that the debtor holds one or more accounts with a bank in a specific Member State, but knows neither the name and/or address of the bank nor the IBAN, BIC or another bank number allowing the bank to be identified, he may request the court with which the application for the Preservation Order is lodged to request that the information authority of the Member State of enforcement obtain the information necessary to allow the bank or banks and the debtor’s account or accounts to be identified.

Ferry Services, B.C. Rail Ltd and B.C. Transportation and Financing Authority: (a) how many acres (or hectares) of farm land will be used for Roberts Bank port and rail related developments now underway or under study; (b) with the completion of the Roberts Bank port expansion, including both the third berth and second terminal, what plans, if any, are there to use the Brunswick Point farmlands; (c) is the affected Roberts Bank farmland presently protected by the B.C.
