6. By way of derogation from Article 16(3) of Directive 2002/21/EC, a national regulatory authority shall not impose a mandatory period of notice before withdrawing a previously imposed obligation to offer a European virtual broadband access product that satisfies the substantive requirements and parameters set out in Article 17(1) and in Annex I, point 2 of this Regulation, if the operator concerned voluntarily commits to make such product available at the request of third parties on fair and reasonable terms for a further period of three years.

Une assurance ou autre garantie financière ne satisfait pas aux prescriptions du présent article si elle peut cesser d'avoir effet, pour une raison autre que l'expiration de la période de validité indiquée dans le certificat, avant l'expiration d'un délai de trois mois à compter de la date où préavis en a été donné à l'autorité spécifiée au paragraphe 5, à moins que le certificat n'ait été restitué à cette autorité ou qu'un nouveau certificat n'ait été délivré avant la fin de ce délai.
6. An insurance or other financial security shall not satisfy the requirements of this Article if it can cease, for reasons other than the expiry of the period of validity of the insurance or security specified in the certificate, before three months have elapsed from the date on which notice of its termination is given to the authorities referred to in paragraph 5, unless the certificate has been surrendered to these authorities or a new certificate has been issued within the said period.
