1. Each Member State shall ensure that in the course of criminal proceedings against a person, previous convictions handed down against the same person for different facts in other Member States, in respect of which information has been obtained under applicable instruments on mutual legal assistance or on the exchange of information extracted from criminal records, are taken into account to the extent previous national convictions are taken into account, and that equivalent legal effects are attached to them as to previous national convictions, in accordance with national law.

Selon cette Convention, l'État de condamnation ne peut demander l'exécution d'une sanction à un autre État contractant que si une ou plusieurs des conditions énumérées à l'art. 5 sont remplies : a) si le condamné a sa résidence habituelle dans l'autre État, b) si l'exécution de la sanction dans l'autre État est susceptible d'améliorer les possibilités de reclassement social du condamné, c) s'il s'agit d'une sanction privative de liberté qui pourrait être exécutée dans l'autre État à la suite d'une autre sanction privative de liberté que le condamné subit ou doit subir dans cet État, d) si l'autre État est l'État d'origine du condamné et s'est déjà déclaré prêt à se charger de l'exécution de cette sanction , ou e) s'il estime qu'il n'est pas en mesure d'exécuter lui-même la sanction, même en ayant recours à l'extradition, et que l'autre État l'est. According to the Convention, the sentencing State may request another Contracting State to enforce a sentence only if one or more of the conditions set out in Article 5 are fulfilled, namely: (a) if the sentenced person is ordinarily resident in the other State; (b) if the enforcement of the sentence in the other State is likely to improve the prospects for the social rehabilitation of the sentenced person; (c) if, in the case of a sentence involving deprivation of liberty, the sentence could be enforced following the enforcement of another sentence involving deprivation of liberty which the sentenced person is undergoing or is to undergo in the other State; (d) if the other State is the State of origin of the sentenced person and has declared itself willing to accept responsibility for the enforcement of that sentence; or (e) if it considers that it cannot itself enforce the sentence, even by having recourse to extradition, and that the other State can. In addition, the judgment handed down in the requesting State must be final and enforceable and the offence in respect of which the sentence has been passed must also constitute an offence under the law of the requested State ("double criminality" requirement [76]).

La Commission vient de déposer une proposition de décision-cadre relative à la prise en compte des décisions de condamnation entre les Etats membres de l'Union Européenne qui pose pour règle générale que chaque Etat membre accorde à une condamnation prononcée dans un autre Etat membre les mêmes effets qu’à une condamnation nationale antérieure et précise certaines modalités d’application de cette règle.
The Commission recently presented a proposal for a Framework Decision on taking account of convictions in the Member States of the European Union, which establishes a general principle whereby each Member State is to attach the same effects to convictions handed down in the other Member States as to national convictions and sets out a series of rules for the application of the principle.
