The Community Patent Court would thus have jurisdiction for the subject matter laid down in Article 1 of the Commission proposal for such a Council Decision, namely for disputes relating to the infringement or the validity of a Community patent and a Community supplementary protection certificate, the use of the invention after the publication of the Community patent application, the right based on prior use of the invention, interim and evidence-protection measures in the subject matters conferred, damages and compensation incurred in the situations referred to above and orders of a penalty payment in case of non-compliance with a decision or order constituting an obligation to act or to abstain from an act.

C'est sur cette approche que repose la proposition d'institution du Tribunal du brevet communautaire, qui aura donc son siège au Tribunal de première instance, sans que prenne forme aucune des possibilités qui avaient été envisagées au Conseil et qui prévoyaient notamment la création de sections régionales permanentes du Tribunal du brevet communautaire dans les États membres.
The proposal for the establishment of a Community Patent Court is built on this approach. Consequently, the Community Patent Court should have its seat at the Court of First Instance without any of the possibilities that had been under discussion in the Council allowing for the establishment of permanent regional divisions of the Community Patent Court in Member States.
