Starting with the budget 2007, with a view to ensuring that the amounts for the financing of the common agricultural policy currently under subheading 1a (market measures and direct aids) respect the annual ceilings set out in the Decision of the Representatives of the Governments of the Member States, meeting within the Council on 18 November 2002, concerning the Conclusions of the European Council meeting in Brussels on 24 and 25 October 2002, an adjustment of the direct payments shall be fixed when the forecasts indicate that the amounts foreseen under subheading 1a taking into account a margin of EUR 300 million below the amounts foreseen and before application of modulation provided for in Article 10(2), will be exceeded in a given budget year. This is without prejudice to the financial perspectives for 2007-2013.

The financial perspective for the year 2006 is modified by transferring EUR 655 million in commitment appropriations from subheading 1a "common agricultural policy" to subheading 1b "rural development" in order to take into account the effect of modulation for the year 2006.

This reduction is in line with the overall approach of controlled growth of payment appropriations, in which it is proposed to include compulsory expenditure (subheading 1a) and non-compulsory expenditure (other headings); it also takes into account recent agricultural market trends;

Takes the view that the requirements under Article 14 of the Financial Regulation are substantiated for the changes to lines against subheading 1a and headings 5 and 7, which were introduced by Letters of Amendment 1 and 2 to the 2000 draft budget and have been accepted unamended; considers that the requirements of Article 14 of the Financial Regulation have not been met for lines against subheading 1b and heading 4, however, and rejects those parts of Letter of Amendment No 2 to the 2000 draft budget on the ground that, as regards those headings, 'very exceptional circumstances' have not been adduced;
