Ms Bellis informed the Senators that as a result of a recommendation by the Senate in 1998, the Commission now undertakes its consideration of adequacy in light of four statutory criteria that are set out in the Judges Act. Those criteria include: the prevailing economic conditions and the current financial position of the federal government; the role of financial security in ensuring judicial independence; the need to attract outstanding candidates to the judiciary; and any other objective criteria that the Commission considers relevant.
