The Commission may decide with effect for the entire Union that a third country, a territory or specified sector within a third country, or an international organisation, offers an adequate level of data protection, thus providing legal certainty and uniformity throughout the Union as regards the third country or international organisation which is considered to provide such level of protection.

As regards the second Altmark criterion, whereby the parameters used to calculate the compensation must be established beforehand in an objective and transparent manner, the Commission has to assess the legal and economic conditions under which the licence fee revenue payable to TV2 was determined during the period under investigation.

As regards the second Altmark criterion, the Commission finds that the parameters of the alleged ‘compensation’ have not been established in advance in an objective and transparent manner.

The problem explained above with regard to third countries does not of course apply to the candidate countries which are destined to become members of the European Union.
