The ESC recommends: - a further preventative analysis of protection systems complementary to the patent, to be described as "utility models" (UM), together with a more complete integration of available assessment data; special regard to be paid in this connection to weaknesses in the EU patent system, which is still seriously incomplete and disparate compared to its main competitors, the USA and Japan; - a guarantee, in the event of proposals for harmonization, not only of measures for the harmonization of substantive laws, but also of procedures and timescales for obtaining and enforcing UMs, together with the introduction of a cheap, quick and easy (especially for SMEs) assessment and enforcement method which excludes substances and processes from eligibility for protection; - a guarantee of eligibility for UMs for innovations which satisfy the following requirements: a) "absolute novelty"; b) "possibility of application in the industrial field"; c) "inventive step" (Art. 56 of the Convention on the European Patent) or which have a practical industrial advantage over the previous state of the art; the scope of protection should emerge from a limited number of "claims" and the search for earlier "state of the art" should be optional in general, and compulsory for those wishing to enforce UM rights vis-à-vis a third party; - investigation into the feasibility of active assistance and advice in respect of national UM deposit and registration procedures being provided for firms - particularly SMEs - by a central Community or European agency; and investigation of the scope for application of computer digital language to the European patent system; - deferral of any measures for mutual recognition until substantive and interpretative harmonization has taken place; a feasibility study on creation of a Community UM covering the whole of Europe could be carried out, but only after a thorough examination to check that harmonization and mutual recognition measures ...
Le Comité recommande : - un nouvel approfondissement préventif des systèmes de protection complémentaires au brevet que l'on veut qualifier de "modèles d'utilités" (MU), grâce à la collecte de nouveaux éléments d'évaluation, considérés dans un rapport plus étroit avec les insuffisances du système des brevets de l'UE, largement inachevé et non homogène, par rapport aux Etats-Unis et au Japon; - la garantie, en cas de propositions d'harmonisation non seulement des mesures d'harmonisation du droit fondamental mais aussi des procédures et des délais relatifs tant en ce qui concerne l'obtention que l'application du MU enregistré, ainsi que de l'introduction d'un instrument peu coûteux, simple, rapide et facile à évaluer et à appliquer, surtout pour les PME, tout en excluant de la protection les substances et les procédés. - une garantie de protection des MU répondant aux conditions de : a) "nouveauté absolue" ; b) "applicabilité industrielle" ; c) "activité inventive" au sens de l'article 56 de la CBE ou, à titre alternatif, avantage pratique/industriel par rapport à l'état antérieur de la technique. L'étendue de la protection devrait découler d'un nombre limité de "revendications" et la recherche d'antériorité devrait être généralement facultative et obligatoire pour faire valoir le droit découlant du MU vis-à-vis d'un tiers. - l'examen de la possibilité de faire jouer à un organisme centralisé communautaire ou européen un rôle actif d'assistance, de conseil et de soutien aux entreprises, les PME, notamment, dans les procédures nationales de dépôt et d'enregistrement du MU ainsi que de la possibilité d'appliquer le langage numérique informatisé au système des brevets ; - le renvoi d'éventuelles mesures de reconnaissance mutuelle à une phase ultérieure à une harmonisation effective, substantielle et interprétative.

The Council also adopted the following conclusions on SME access to financial markets: "COUNCIL CONCLUSIONS ON THE FEASIBILITY OF CREATING A EUROPEAN CAPITAL MARKET FOR SMALL AND MEDIUM-SIZED ENTERPRISES In the light of the debate held on the basis of the Commission's communication on the creation of a European capital market for smaller entrepreneurially managed growth companies and given the opportunity to promote the setting up of innovative projects in any area of activity, strengthening these enterprises' capital structures, in order to facilitate the development of European SMEs and create new jobs in the Union, THE COUNCIL: - welcomes the European Commission's initiative to promote the debate on the creation of new Europe-wide capital markets; - invites the Commission to go deeper into the conclusions of its communication and report to the next Industry Council on ways to overcome the various obstacles currently existing in the Member States, including obstacles inhibiting the channelling of funds of institutional and private investors, in order to support the creation of secondary European Capital Markets for SMEs, taking into account the national systems and experiences already under way; - submits to the Commission's consideration the advisability of encouraging investors to join the European secondary capital market in order to mobilise additional financial resources for European SMEs; - urges the Commission to cooperate with Member States in order to overcome the difficulties that exist in making cross-border security transactions, by facilitating progress towards the future operation of a pan-European secondary capital Market, such as EASDAQ (European Association of Security Dealers Automated Quotation).

II. WITH RESPECT TO RESEARCH AND PHARMACEUTICAL INNOVATION 1. notes with satisfaction that the 4th Framework Programme of Community Activities in the field of Research, Technological Development and Demonstration takes into account the special characteristics of pharmaceutical research in a specific programme relating to biomedicine and health; 2. notes that the Commission is setting up a Task Force on vaccinations and viral diseases which it considers will encourage partnership between industry, public research institutes and university circles; 3. notes with interest, having regard in particular to the Council Resolution of 20 December 1995, [11] that the Commission will carry out studies and, where necessary, submit appropriate proposals to create an economic environment which encourages the pharmaceutical industry to carry out research in the field of orphan drugs; 4. underlines the need to continue to guarantee the protection of intellectual property with regard to pharmaceutical innovations; 5. stresses the importance of an efficient chemical industry in the process of innovation of the pharmaceutical industry; 6. underlines the growing importance of biotechnology in the pharmaceutical sector; is aware of the problems and new opportunities opened up by biotechnology; invites the Commission to continue its efforts to ensure a stable and safe environment for biotechnology, particularly by tailoring regulations to the actual risk taken while maintaining an appropriate level of safety and seeking a favourable framework for stimulating investment in Europe; 7. notes with interest that the Commission has submitted a new proposal to the European Parliament and to the Council on the legal protection of biotechnological inventions in order to improve legal protection and Community harmonization in matters relating to the patentability of biotechnological inventions, with due regard for bioethics and the cultural roots of Europe.
II EN CE QUI CONCERNE LA RECHERCHE ET L'INNOVATION PHARMACEUTIQUE 1. note avec satisfaction que le 4ème Programme-cadre pour des actions communautaires de Recherche et de Développement technologique et de démonstration prend en compte les particularités de la recherche pharmaceutique dans un programme spécifique traitant de la biomédecine et de la santé; 2. note que la Commission met en place une Task force "vaccins et maladies virales" visant selon elle à encourager un partenariat entre l'industrie, les instituts publics de recherche et les milieux universitaires ; 3. note avec intérêt, eu égard notamment, à la résolution du Conseil du 20 décembre 1995 [11] , que la Commission entreprend des études et, le cas échéant, présentera des propositions pertinentes aux fins de créer un environnement économique incitant l'industrie pharmaceutique à faire de la recherche dans le domaine des médicaments orphelins; 4. souligne le besoin de continuer à garantir la protection de la propriété intellectuelle concernant les innovations pharmaceutiques; 5. relève l'importance d'une industrie chimique performante dans le processus d'innovation du secteur pharmaceutique; 6. souligne l'importance croissante de la biotechnologie dans le secteur pharmaceutique; est conscient des problèmes ainsi que des nouvelles possibilités ouvertes par la biotechnologie; invite la Commission à poursuivre ses efforts pour assurer un environnement stable et sûr à la biotechnologie, notamment en adaptant la réglementation au risque effectif encouru tout en maintenant un niveau de sécurité approprié et en recherchant un cadre favorable pour stimuler les investissements en Europe; 7. note avec intérêt que la Commission a présenté une nouvelle proposition au Parlement européen et au Conseil relative à la protection juridique des inventions biotechnologiques afin de favoriser la sécurité juridique et l'harmonisation communautaire en matière de brevetabilité des inventions biotechnologiques dans le res ...
