The Community patent title covering the territory of all EU Member States should not only be granted according to the uniform standards of the European Patent Convention and after grant be governed by the uniform provisions of Community law contained in the Community patent regulation. It should also be effectively enforceable before a Community jurisdiction guaranteeing high quality decisions in a quick, inexpensive and uniform procedure.
Ce titre, qui sera valable dans tous les États membres de l'UE, devra non seulement être octroyé conformément aux règles uniformes énoncées dans la Convention sur le brevet européen et, après sa délivrance, être régi par les dispositions juridiques uniformes du règlement sur le brevet communautaire, mais il devra aussi pouvoir être invoqué devant une juridiction communautaire afin de garantir la prise de décisions de haute qualité dans le cadre d'une procédure rapide, uniforme et peu coûteuse.

The Community patent title covering the territory of all Member States will not only be governed by the uniform provisions of Community law contained in the regulation of the Council on the Community patent. It will, at the latest by 2010, after a transitional period during which national courts will retain jurisdiction for the subject matter, also be enforceable before a Community jurisdiction whose decisions enjoy Community wide effect.
Celui-ci, qui sera valable dans l'ensemble des États membres, sera non seulement régi par les dispositions juridiques uniformes du règlement du Conseil sur le brevet communautaire, mais il pourra aussi être invoqué en justice, au plus tard en 2010 au terme d'une période de transition durant laquelle les tribunaux nationaux resteront compétents, devant une juridiction communautaire dont les décisions seront exécutoires dans toute la Communauté.

1. Where a national patent granted in a Member State relates to an invention for which a Community patent has been granted to the same inventor or to his successor in title with the same date of filing, or, if priority has been claimed, with the same date of priority, that national patent shall be ineffective to the extent that it covers the same invention as the Community patent, from the date on which:
