Tout État contractant peut conclure avec un ou plusieurs États contractants des accords qui contiennent des dispositions sur les matières réglées par la convention afin d’améliorer l’application de la convention entre eux, à condition que de tels accords soient conformes à l’objet et au but de la convention et n’affectent pas, dans les rapports de ces États avec d’autres États contractants, l’application des dispositions de la convention.
(2) Any Contracting State may conclude with one or more Contracting States agreements, which contain provisions on matters governed by the Convention, with a view to improving the application of the Convention between or among themselves, provided that such agreements are consistent with the objects and purpose of the Convention and do not affect, in the relationship of such States with other Contracting States, the application of the provisions of the Convention.

6. Les parties conviennent que la tenue de consultations et la communication d'informations au sein des institutions d'un accord de partenariat économique sur des thèmes couverts par de tels accords se font conformément aux dispositions du présent article et de l'article 12 du présent accord, pour autant que les États ACP susceptibles d'être affectés soient tous signataires de l'accord de partenariat économique dans le cadre duquel les consultations se sont tenues ou les informations ont été communiquées».
6. The Parties agree that holding consultations within, and providing information through, the institutions of an Economic Partnership Agreement on matters within the scope of such agreements shall be deemed to also satisfy the provisions of this Article and of Article 12 of this Agreement, provided that the ACP States likely to be affected are all signatories to the Economic Partnership Agreement within which the consultations were held or information was provided’.

(40) Les divergences existantes et émergentes entre les législations et les jurisprudences des États membres dans le domaine de la responsabilité des prestataires de services agissant en qualité d'intermédiaires empêchent le bon fonctionnement du marché intérieur, en particulier en gênant le développement des services transfrontaliers et en produisant des distorsions de concurrence. Les prestataires des services ont, dans certains cas, le devoir d'agir pour éviter les activités illégales ou pour y mettre fin. La présente directive doit constituer la base adéquate pour l'élaboration de mécanismes rapides et fiables permettant de retirer les informations illicites et de rendre l'accès à celles-ci impossible. Il conviendrait que de tels mécanismes soient élaborés sur la base d'accords volontaires négociés entre toutes les parties concernées et qu'ils soient encouragés par les États membres. Il est dans l'intérêt de toutes les parties qui participent à la fourniture de services de la société de l'information d'adopter et d'appliquer de tels mécanismes. Les dispositions de la présente directive sur la responsabilité ne doivent pas faire obstacle au développement et à la mise en oeuvre effective, par les différentes parties concernées, de systèmes techniques de protection et d'identification ainsi que d'instruments techniques de surveillance rendus possibles par les techniques numériques, dans le respect des limites établies par les directives 95/46/CE et 97/66/CE.
(40) Both existing and emerging disparities in Member States' legislation and case-law concerning liability of service providers acting as intermediaries prevent the smooth functioning of the internal market, in particular by impairing the development of cross-border services and producing distortions of competition; service providers have a duty to act, under certain circumstances, with a view to preventing or stopping illegal activities; this Directive should constitute the appropriate basis for the development of rapid and reliable procedures for removing and disabling access to illegal information; such mechanisms could be developed on the basis of voluntary agreements between all parties concerned and should be encouraged by Member States; it is in the interest of all parties involved in the provision of information society services to adopt and implement such procedures; the provisions of this Directive relating to liability should not preclude the development and effective operation, by the different interested parties, of technical systems of protection and identification and of technical surveillance instruments made possible by digital technology within the limits laid down by Directives 95/46/EC and 97/66/EC.

Les parties contractantes peuvent conclure des accords bilatéraux ou multilatéraux, y compris des accords régionaux ou sous-régionaux, pour la protection du milieu marin de la zone de la mer Méditerranée contre la pollution, sous réserve que de tels accords soient compatibles avec la présente convention et conformes au droit international.

The Contracting Parties may enter into bilateral or multilateral agreements, including regional or sub-regional agreements, for the protection of the marine environment of the Mediterranean Sea against pollution, provided that such agreements are consistent with this Convention and conform to international law.
