Expresses its concern that the European Court of Justice’s decisions in the recent Viking, Laval and Rüffert cases may adversely affect the exercise of fundamental rights such as the right to strike and undermine national traditions in collective bargaining and public procurement; calls on the European Commission, therefore, to restate its unequivocal commitment to upholding social rights and equal pay for equal work and to examine urgently, together with Parliament and the social partners, what changes may be needed to the Posting of Workers Directive and other legislation; calls upon the European Council to adopt a declaration to the effect that neither the Treaty nor EU legislation should be interpreted as affecting in any way the exercise of fundamental rights as recognised in the Member States, in ILO Conventions Nos 87 and 98 and in the Charter of Fundamental Rights of the European Union, including the right to take industrial action;
