40.1. 40.1. In accordance with Article 129(3) of the Treaty on the Functioning of the European Union, Articles 5.1, 5.2, 5.3, 17, 18, 19.1, 22, 23, 24, 26, 32.2, 32.3, 32.4, 32.6, 33.1(a) and 36 of this Statute may be amended by the European Parliament and the Council, acting in accordance with the ordinary legislative procedure either on a recommendation from the ECB and after consulting the Commission, or on a proposal from the Commission and after consulting the ECB.

L'Agence devrait avoir le droit de formuler des avis à l'intention des institutions de l'Union, ainsi qu'à l'intention des États membres lorsqu'ils mettent en œuvre le droit communautaire, soit de sa propre initiative, soit à la demande du Parlement européen, du Conseil ou de la Commission, sans qu'il y ait d'interférence avec les procédures législatives et juridictionnelles instaurées par le traité.
The Agency should have the right to formulate opinions to the Union institutions and to the Member States when implementing Community law, either on its own initiative or at the request of the European Parliament, the Council or the Commission, without interference with the legislative and judicial procedures established in the Treaty.
