In order to ensure that, when executing contracts, economic operators comply with the applicable environmental, social and labour law obligations established by Union law, national legislation, collective agreements or the applicable international social and environmental conventions listed in Annex X to Directive 2014/24/EU, such obligations should be part of the minimum requirements defined by the contracting authority and should be integrated in the contracts signed by the contracting authority.

5. Les pouvoirs adjudicateurs et les entités adjudicatrices au sens de l’article 7, paragraphe 1, point a), excluent l’opérateur économique de la participation à une procédure d’attribution de concession s’ils ont connaissance d’un manquement par l’opérateur économique à ses obligations relatives au paiement d’impôts et taxes ou de cotisations de sécurité sociale et si ce manquement a été établi par une décision judiciaire ou administrative ayant force de chose jugée, conformément aux dispositions légales du pays dans lequel il est établi ou à celles de l’État membre des pouvoirs adjudicateurs ou des entités adjudicatrices.
5. Contracting authorities and contracting entities as referred to in point (a) of Article 7(1) shall exclude the economic operator from participation in a concession award procedure where it is aware that the economic operator is in breach of its obligations relating to the payment of taxes or social security contributions and where this has been established by a judicial or administrative decision having final and binding effect in accordance with the legal provisions of the country in which it is established or with those of the Member State of the contracting authority or contracting entity.

3. 3. Where a contracting authority/entity establishes that a tender is abnormally low because the tenderer has obtained State aid, the tender can be rejected on that ground alone only after consultation with the tenderer where the latter is unable to prove, within a sufficient time-limit fixed by the contracting authority/entity, that the aid in question was granted legally.

This Directive is based on Court of Justice case-law, in particular case-law on award criteria, which clarifies the possibilities for the contracting authorities to meet the needs of the public concerned, including in the environmental and/or social area, provided that such criteria are linked to the subject-matter of the contract, do not confer an unrestricted freedom of choice on the contracting authority, are expressly mentioned and comply with the fundamental principles mentioned in recital 2.
