6. Les dispositions du paragraphe 5 ne sont pas applicables, dès lors que la Commission a fait savoir aux entreprises intéressées qu'après examen provisoire elle estime que les conditions d'application de l'article 85, paragraphe 1, du traité sont remplies et qu'une application de l'article 85, paragraphe 3, n'est pas justifiée.
6. Paragraph 5 shall not have effect where the Commission has informed the undertakings concerned that after preliminary examination it is of opinion that Article 85 (1) of the Treaty applies and that application of Article 85 (3) is not justified.
