3. Paragraph 1 shall not apply where the presence of a person is required for the fulfilment of a judicial process or exclusively for medical, safety or other humanitarian purposes, or the Sanctions Committee has determined on a case-by-case basis that the expulsion of a person would be contrary to the objectives of UNSCRs 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013) and 2270 (2016), or the relevant Member State has determined on a case-by-case basis that the expulsion of a person would be contrary to the objectives of this Decision.

2. Major companies that repeatedly violate human rights and the rights of workers must be brought to the point where they comply with the criteria for proper and decent work, and this should be done by means of sanctions, such as – and this would be appropriate – their being excluded from application for public procurement tenders and from export credit guarantees issued by international financial institutions.

J’ai donc voté en faveur des première et dernière parties du point 6, et je me suis par contre abstenu sur les parties intermédiaires qui préconisaient une sanction concrète - soit parce que cette mesure serait prématurée en l’absence d’une base juridique adéquate, soit parce qu’une telle sanction économique pourrait être en déséquilibre avec la deuxième situation, lorsqu’il s’agit de simples infractions administratives.
I therefore voted in favour of the first and last parts of paragraph 6 but abstained on the middle parts which advocated a specific penalty. This financial penalty would have been premature without an adequate legal basis and would have been out of proportion in the second situation of a simple administrative infringement.
