Where a competent authority has not applied the legally binding acts and legislation referred to in Article 1(2) or has applied them in a way which appears to be in breach of Union law, including the technical standards established in accordance with Article 7, in particular by failing to ensure that a financial institution satisfies the requirements laid down in that legislation, the Authority shall have the powers set out in paragraphs 2, 3 and 6 of this Article.
