1. Lorsque la législation d’une des Parties contractantes rend l’acquisition, le maintien ou la récupération de l’admissibilité à une prestation conditionnelle à l’accumulation des périodes admissibles, et lorsqu’une personne n’est pas admissible à une prestation parce qu’elle n’a pas accumulé suffisamment de périodes admissibles aux termes de ladite législation pour être admissible à ladite prestation, l’institution compétente de ladite Partie contractante tient compte des périodes admissibles accumulées aux termes de la législation de l’autre Partie contractante pour déterminer l’admissibilité de ladite personne à ladite prestation comme il est précisé aux paragraphes 2 à 5, pour autant que lesdites périodes ne se superposent pas.
1. Where the legislation of a Contracting Party makes the acquisition, maintenance or recovery of eligibility for a benefit conditional upon the accumulation of creditable periods, and where a person is not eligible for a benefit because he or she has not accumulated sufficient creditable periods under that legislation to be eligible for that benefit, the competent institution of that Contracting Party, in determining the eligibility of that person for that benefit, shall take into account creditable periods accumulated under the legislation of the other Contracting Party as specified in paragraphs 2 through 5, provided that the periods do not overlap.

Si, après l’entrée en vigueur du présent Accord, une personne présente une demande écrite de prestations à l’agence d’un État contractant aux termes de la législation dudit État contractant, et si ladite personne n’a pas demandé expressément que la demande soit limitée aux prestations prévues aux termes de ladite législation, la demande protégera également les droits de ladite personne aux prestations correspondantes prévues par la législation de l’autre État contractant, pourvu que ladite personne, au moment de la demande :
If, after the entry into force of this Agreement, a person files a written application for benefits with the agency of a Contracting State under the legislation of that Contracting State, and if that person has not explicitly requested that the application be restricted to benefits under that legislation, the application shall also protect the rights of that person to corresponding benefits under the legislation of the other Contracting State, provided that the person at the time of application:

1. When the legislation of a Contracting Party makes the acquisition, retention or recovery of the right to a benefit subject to the completion of prescribed creditable periods and a person has not completed sufficient creditable periods under that legislation to fulfill those conditions, the competent organization of that Contracting Party shall determine the eligibility of that person for that benefit by totalizing those creditable periods and creditable periods under the legislation of the other Contracting Party, as specified in this Part, provided that those periods do not overlap.

If the legislation of Spain makes award of a benefit conditional on the fact that the person concerned must be subject to that legislation at the time of the occurrence of the contingency which gives rise to the benefit, this condition shall be deemed to be met if, at that time, that person is insured under the legislation of Canada or, if that is not the case, is in receipt of a benefit of the same kind under the legislation of Canada or a benefit of a different kind but one paid on account of the beneficiary him/herself.

Any person who is or who has been subject to the legislation of any Party, and the dependants and survivors of such a person, shall, while in the territory of any other Party, be subject to the obligations of the legislation of either of the other Parties and shall be eligible for the benefits of that legislation under the same conditions as a person subject to the legislation of that other Party.

Sans préjudice des compétences dévolues à la Commission au titre de l'article 258 du traité sur le fonctionnement de l'Union européenne, si une autorité compétente ne se conforme pas à la décision de l'autorité visée aux paragraphes 3 et 3 bis dans le délai imparti par ladite décision, l'Autorité peut, lorsque les exigences concernées figurant dans les actes législatifs visés à l'article 1, paragraphe 2, y compris les normes techniques de réglementation et d'exécution adoptées conformément auxdits actes, sont directement applicables aux établissements financiers, adopter à l'égard d'un établissement financier une décision individuelle lui imposant de prendre les mesures nécessaires pour respecter les obligations qui lui incombent en vertu de ladite législation, notamment la cessation d'une pratique.
Without prejudice to the powers of the Commission pursuant to Article 258 TFEU, where a competent authority does not comply with the decision of the authority referred to in paragraphs 3 and 3a within the period laid down in that decision, the Authority may, where the relevant requirements laid down in the legislative acts referred to in Article 1(2) including in regulatory technical standards and implementing technical standards adopted in accordance with those acts are directly applicable to financial institutions, adopt an individual decision addressed to a financial institution requiring the necessary action to comply with its obligations under that legislation, including the cessation of any practice.

Reminds the Member States that they have publicly committed themselves to achieving the goal of a Single European Sky, overwhelmingly supporting the relevant legislation, and insists that they must remain proactive and involved in the implementation of this legislation; calls on the Member States, in this connection, to submit national performance plans in line with EU performance targets, and to adopt the revised performance targets proposed by the Commission; calls on the Commission to initiate appropriate action in case of failure to meet the deadlines for the implementation of this legislation;

1. To ensure that products benefiting from the free movement of goods within the Community respect a high level of protection of public interests such as health and safety in general, health and safety at the workplace, protection of consumers and of the environment, while ensuring that the free movement of products is not restricted beyond what is allowed under Community harmonisation legislation and any other relevant Community rules, this Regulation provides a framework supporting specific rules of existing and future sectoral Community harmonisation legislation, without making any substantive changes to that legislation, in particular not to rules contained therein relating to protection of health and the environment and any specific rules on accreditation and market surveillance that may be contained therein.

If a person receives benefits under the legislation of one Member State in respect of an injury resulting from events occurring in another Member State, the provisions of the said legislation which determine the cases in which the civil liability of employers or of their employees is to be excluded shall apply with regard to the said person or to the competent institution.

Si une personne bénéficie de prestations en vertu de la législation d'un État membre pour un dommage résultant de faits survenus sur le territoire d'un autre État membre, les dispositions de ladite législation qui déterminent les cas dans lesquels est exclue la responsabilité civile des employeurs ou de travailleurs salariés qu'ils occupent sont applicables à l'égard de ladite personne ou de l'institution compétente.
2. If a person receives benefits pursuant to the legislation of one Member State in respect of an injury resulting from events occuring in the territory of another Member State, the provisions of the said legislation which determine in which cases the civil liability of employers or of the persons employed by them is to be excluded shall apply with regard to the said person or to the competent institution.
