It is possible to infer from the terms of the judgment of 9 March 2012 in Case C-564/10 Bundesanstalt für Landwirtschaft and Ernährung v Pfeifer Langen KG that Article 3 of Regulation No 2988/95 (1) laying down Community law limitation rules is applicable to measures seeking payment of interest due pursuant to Article 52 of Regulation No 800/1999 (2) and Article 5a of Regulation No 770/96? (3)

La Cour de justice des Communautés européennes, dans son arrêt du 11 juillet 2006, dans l'affaire C-313/04 Franz Egenberger GmbH Molkerei und Trockenwerk contre Bundesanstalt für Landwirtschaft und Ernährung, a estimé que: «L’article 35, paragraphe 2, du règlement (CE) no 2535/2001 de la Commission du 14 décembre 2001 portant modalités d’application du règlement (CE) no 1255/1999 du Conseil en ce qui concerne le régime d’importation du lait et des produits laitiers et l’ouverture de contingents tarifaires, est invalide en tant qu’il dispose que les demandes de certificat d’importation pour du beurre néo-zélandais à droits réduits ne peuvent être déposées qu’auprès des autorités compétentes du Royaume-Uni»; et que «les articles 25 et 32 du règlement (CE) no 2535/2001, lus en combinaison avec les annexes III, IV et XII de ce même règlement, sont invalides dans la mesure où ils permettent une discrimination dans la délivrance des certificats d’importation pour du beurre néo-zélandais à droits réduits».

Bundesanstalt für Landwirtschaft und Ernährung stated that: ‘Article 35(2) of Commission Regulation (EC) No 2535/2001 of 14 December 2001 laying down detailed rules for applying Council Regulation (EC) No 1255/1999 as regards the import arrangements for milk and milk products and opening tariff quotas is invalid inasmuch as it provides that applications for import licences for New Zealand butter at reduced duty may be lodged solely with the competent authorities of the United Kingdom’; and ‘Articles 25 and 32 of Regulation (EC) No 2535/2001, read in conjunction with Annexes III, IV and XII to that Regulation, are invalid since they permit discrimination in the issue of import licences for New Zealand butter at reduced duty’.
