Étant donné que la directive 79/409/CEE du Conseil a comme objectif la protection, une gestion équilibrée et la réglementation de l'exploitation des oiseaux sauvages présents sur le territoire des États membres et que le phénomène de la migration dépasse les frontières territoriales, pour s'effectuer dans des conditions diverses, étant donné d'autre part que la politique de l'UE doit prendre en considération l'évolution de la situation des oiseaux sauvages, par rapport non seulement au territoire communautaire mais également aux zones de répartition et que la diversité climatique, ornithologique, culturelle des différents États membres devrait se traduire par le pouvoir discrétionnaire de ceux­ci en ce qui concerne les dates de la saison de la chasse (entre le 15 juillet et le 28 février) selon des critères précis, la Commission est­elle disposée à modifier la directive susmentionnée, en particulier l'article 7 paragraphe 4, de façon à éviter une application incorrecte et un conflit juridique au niveau communautaire et national ?
The purpose of Council Directive 79/409 is the protection, balanced management and rational exploitation of wild birds in the territory of the Member States and migration is a cross-border phenomenon. Furthermore, the EU’s policy must take account of the changing habits of wild birds, in relation not only to Community territory, but the other areas where they are found. In view of the climatic and cultural differences between the various Member States and the different bird species found there, the Member States should be able to use their discretion in setting the dates of the hunting season (between 15 July and 28 February) whilst respecting precise criteria. Is the Commission willing to amend the directive, in particular Article 7(4) thereof, and hence prevent divergence in its application and a consequent legal dispute at Community and national level?

The Commission considers that the French authorities failed to fulfil their obligations under the Directive by publishing a contract notice quoting purely French qualifications without mentioning the equivalence of qualifications from other Member States and by confusing the various criteria envisaged at the time of the procedure in order to award the contract to the locally-established tenderer.
