(21) S'agissant de l'application de la présente directive, les États membres devraient veiller à ce que les personnes présentant un handicap bénéficient pleinement des droits prévus dans la directive, sur un pied d'égalité avec les autres citoyens, conformément à la convention des Nations unies relative aux droits des personnes handicapées, notamment à ses dispositions consacrées au droit à la reconnaissance de la personnalité juridique dans des conditions d’égalité, à l'égalité d'accès à la justice, au droit d'accès à l'information et à l'accessibilité des bâtiments, ainsi qu'au droit de ne pas être soumis à des peines ou traitements inhumains ou dégradants et au droit de ne pas être soumis à la violence et à la maltraitance.
(21) In applying the provisions of this Directive, Member States should ensure that persons with disabilities fully enjoy the rights under the Directive on an equal basis with others, in accordance with the UN Convention on the Rights of Persons with Disabilities, particularly the Convention's provisions on the right to equal recognition before the law, equal access to justice, the right to have access to information and accessibility to premises as well as the freedom from inhuman or degrading treatment and freedom from violence and abuse.
