Ilda Figueiredo (GUE/NGL ), in writing (PT) We voted in favour of this resolution because we are against the death penalty and therefore oppose the Libyan court’s decision to sentence five Bulgarian nurses and a Palestinian doctor to death by firing squad, and the confirmation of those sentences on 19 December 2006.

Where, in the decision closing the proceedings, the Tribunal has ordered another party to pay the costs of the recipient of legal aid, that other party shall be required to refund to the cashier of the Tribunal any sums advanced by way of aid (first subparagraph of Article 113(3) of the Rules of Procedure).

F. considérant que, à la suite des protestations, le gouvernement a modifié la loi sur le tribunal pour les crimes internationaux de 1973, afin d'introduire une disposition permettant aux demandeurs d'interjeter appel d'un verdict rendu par le tribunal; considérant que la décision du tribunal contre Abdul Qader Mollah peut de ce fait être annulée et remplacée par une condamnation à mort; considérant que cette forme de législation à effet rétroactif viole les normes en matière de procès équitables, compromet la légitimité du travail du tribunal et bafoue le principe «non bis in idem» du droit international, qui est également consacré à l'article 14, paragraphe 7, du pacte international relatif aux droits civils et politiques, auquel le Bangladesh est partie;
F. whereas in the wake of the protests, the government amended the ICT Act of 1973 to introduce a provision allowing plaintiffs to appeal against a verdict delivered by the Tribunal; whereas the court ruling against Abdul Qader Mollah can thus be overturned in favour of a death sentence; whereas this form of retroactive legislation violates fair trial standards, undermines the legitimacy of the ICT’s work and violates the prohibition on double jeopardy (‘ne bis in idem ’) in international law, which is also laid down in Article 14(7) of the International Covenant on Civil and Political Rights, to which Bangladesh is a party;

B. whereas on 6 May 2004 the Court sentenced five Bulgarian nurses and a Palestinian doctor to death by firing squad; whereas on 25 December 2005 the Libyan Supreme Court issued its ruling on the appeal against the death sentence and ordered a new trial; whereas a new trial was held from 11 May 2006 and the death sentences were confirmed on 19 December 2006,

Cette situation a considérablement empiré le 6 mai dernier, lorsqu’un tribunal libyen a condamné les infirmières bulgares à être fusillées par un peloton d’exécution.
This situation was dramatically worsened on 6 May last year when a Libyan court sentenced the Bulgarian nurses to death by firing squad.
