Following the assessment of all Hungarian replies, the Commission upholds its view that the modified law violates the freedom to provide services (Article 56 TFEU); the freedom of establishment (Article 49 TFEU); Directive 2006/123/EC on services in the internal market (Article 16); the right of academic freedom, the right to education and the freedom to conduct a business as provided by the Charter of Fundamental Rights of the European Union (Articles 13, 14, 16 respectively); as well as the Union's legal obligations under international trade law (the General Agreement on Trade in Services – GATS – in the framework of the World Trade Organisation, WTO).

En ce qui concerne la démocratie et l’État de droit, la question de la primauté du droit, notamment, reste particulièrement préoccupante et requiert d’urgence l’attention du gouvernement, de l’Assemblée et des autorités judiciaires du Kosovo.
As regards democracy and rule of law, the rule of law in particular continues to be an issue of serious concern and needs urgent attention from the government, assembly and judicial authorities of Kosovo.

En outre, la Commission reste également d'avis que la nouvelle législation va à l'encontre de la liberté académique, du droit à l'éducation et de la liberté d'entreprise consacrés par la charte des droits fondamentaux de l'Union européenne, et qu'elle n'est pas compatible avec les obligations juridiques de l'Union en matière de droit commercial international, à savoir l'accord général sur le commerce des services (AGCS), dans le cadre de l'Organisation mondiale du commerce (OMC).
In addition, the Commission also remains of the opinion that the new legislation runs counter to the right of academic freedom, the right to education and the freedom to conduct a business as provided by the Charter of Fundamental Rights of the European Union and the Union's legal obligations under international trade law (the General Agreement on Trade in Services, GATS, in the framework of the World Trade Organisation, WTO).

Un dialogue et une coopération entre l'UE et la Tunisie en matière de sécurité ne sauraient être mis en œuvre que dans le plein respect du droit international relatif aux droits de l'homme, des libertés fondamentales, ainsi que des principes démocratiques inscrits dans la Constitution tunisienne.
EU-Tunisia security dialogue and cooperation can only be implemented in full respect of international human rights and fundamental freedom standards and the democratic principles enshrined in the Tunisian Constitution.
