3. By derogation from point (b) of paragraph 2, where national minimum standards based on Community standards have been newly introduced at the time the application is received, assistance may be granted regardless of non-compliance with those standard on the condition that the holding shall meet the new standards by the end of the realisation of the investment.

(5) Il convient de regrouper les nouvelles mesures de "respect des normes communautaires" créées pour les nouveaux États membres au cours des négociations d'adhésion et les mesures de "respect des normes" introduites par le règlement (CE) n° 1783/2003 du Conseil du 29 septembre 2003 modifiant le règlement (CE) n° 1257/1999 du Conseil concernant le soutien au développement rural par le Fonds européen d'orientation et de garantie agricole (FEOGA)(7) de manière à éviter tout double emploi tout en maintenant les possibilités offertes aux nouveaux États membres dans le cadre de la mesure de respect des normes.
(5) The new measures "Compliance with Community standards" created for the new Member States during accession negotiations and "meeting standards" introduced by Council Regulation (EC) No 1783/2003 of 29 September 2003 amending Regulation (EC) No 1257/1999 on support for rural development from the European Agricultural Guidance and Guarantee Fund (EAGGF)(7) should be amalgamated in such a way as to avoid an overlap between them whilst maintaining the possibilities available to the new Member States under the compliance measure.
