La Commission européenne a décidé d'envoyer à l'Espagne une injonction formelle de se conformer à un arrêt de la Cour de justice européenne du 13 mai 2003, dans lequel la Cour a dit pour droit qu’en maintenant en vigueur certaines dispositions de sa loi de privatisation n° 5/1995, ainsi que les décrets royaux concernant Repsol SA, Telefónica de España SA, Telefónica Servicios Móviles SA, Argentaria, Tabacalera SA, et Endesa SA, dans la mesure où ils prévoient l'application d'un régime d'autorisation administrative préalable , l'Espagne avait manqué aux obligations qui lui incombaient en vertu des règles du traité CE en matière de libre circulation des capitaux (article 56).
The European Commission has decided to send Spain a formal request to comply with a European Court of Justice ruling of 13 May 2003, which found that by maintaining in force certain provisions of its privatisation Law 5/1995, as well as Royal Decrees on Repsol SA, Telefónica de España SA, Telefónica Servicios Móviles SA, Argentaria, Tabacalera SA, and Endesa SA, in so far as they implement a system of prior administrative approval, Spain had failed to fulfil its obligations under EC Treaty rules on the free movement of capital (Article 56).

La Commission européenne a décidé de rappeler à l’Espagne l’obligation dans laquelle elle se trouve de se conformer à un arrêt de la Cour de justice du 13 mai 2003, qui concluait qu’en maintenant en vigueur certaines dispositions précises de sa loi de privatisation 5/1995, ainsi que les décrets royaux relatifs aux sociétés Repsol SA, Telefónica de España SA, Telefónica Servicios Móviles SA, Argentaria, Tabacalera SA et Endesa SA, dans la mesure où ils prévoient l’application d’un régime d'autorisation administrative préalable, l’Espagne manquait aux obligations qui lui incombent en vertu des dispositions du traité CE sur la libre circulation des capitaux (article 56).

In its ruling of 13 May 2003 in Case C-463/00, the Court of Justice found that, by maintaining in force the provisions of Article 2 and Article 3(1) and (2) of Law 5/1995 on the legal arrangements for disposal of public shareholdings in certain undertakings of 23 March 1995, as well as Royal Decrees on Repsol SA, Telefónica de España SA, Telefónica Servicios Móviles SA, Argentaria, Tabacalera SA, and Endesa SA, in so far as they implement a system of prior administrative approval, Spain had failed to fulfil its obligations under EC Treaty rules on the free movement of capital (Article 56).
