Following a preliminary investigation into the case, the Commission has informed Export Italia that the latter enjoys a dominant position on the Italian cola market, and that it considers that the abovementioned fidelity rebates violate Article 86 of the EEC Treaty, as it encourages the distributors to sell only Coca-Cola and, therefore, prevents or hinders competing producers from entering the Italian colas market.

La Commission a constaté que, sur ces routes, les membres de CEWAL enfreignaient l'article 86 en abusant de leur position dominante de trois manières différentes, afin d'écarter leur principal concurrent, GC (service assuré en commun par l'armateur belge Cobelfret et l'armateur italien Grimaldi): 1) ils étaient parties à un accord de coopération conclu avec les autorités maritimes zaïroises (Ogefrem - Office zairois de gestion de fret maritime), en vertu duquel toutes les cargaisons empruntant cette ligne devaient être transportées par des membres de CEWAL; 2) ils recouraient à la pratique dite des "navires de combat".
The Commission has found that on these routes the members of CEWAL abused their dominant market position, in breach of Article 86, in three different ways in order to eliminate competition from their chief competitor, GC (a common service between the Belgian shipowner Cobelfret and the Italian shipowner Grimaldi):- 1: They participated in a cooperation agreement with the Zairean maritime authorities (Ogefrem: l'Office Zairois de Gestion de Fret Maritime) under which all cargo on this line would be carried by CEWAL members. 2: They used the "fighting ships" method.
