Suite à un premier examen de l'affaire, la Commission a informé Export Italia qu'elle estimait que celle-ci possédait une position dominante sur le maarché italien des boissons au cola et que, selon elle, lesdits rabais de fidelité étaient contraires à l'article 86 du Traité CEE puisqu'ils avaient pour effet d'inciter les distributeurs à vendre exclusivement "Coca-Cola" et, par conséquent, d'empêcher les producteurs concurrents d'accéder à une partie essentielle du marché italien des boissons au cola.
Following a preliminary investigation into the case, the Commission has informed Export Italia that the latter enjoys a dominant position on the Italian cola market, and that it considers that the abovementioned fidelity rebates violate Article 86 of the EEC Treaty, as it encourages the distributors to sell only Coca-Cola and, therefore, prevents or hinders competing producers from entering the Italian colas market.
