The Commission shall be empowered to adopt delegated acts in accordance with Article 210 concerning detailed rules on the further definition and scope of public and concession contracts, on applicable nomenclature by reference to the “Common Procurement Vocabulary”, on mixed contracts, on economic operators, as well as on framework contracts and specific contracts based thereon, covering the maximum duration of framework contracts and the award of and methods for implementing specific contracts based on framework contracts concluded with a single economic operator or with several economic operators, respectively’.

Le renvoi à la décision-cadre relative à la protection des données à caractère personnel traitées dans le cadre de la coopération policière et judiciaire en matière pénale, figurant au considérant 14 de la proposition, garantit que les normes prévues dans ladite décision-cadre s'appliquent aussi au cas d'espèce. À ce propos, il est nécessaire d'aligner le considérant 10 de la décision-cadre 2008/XX/JAI relative à l'organisation et au contenu des échanges d'informations extraites du casier judiciaire entre les États membres, qui fait référence à la convention du Conseil de l'Europe pour la protection des personnes à l'égard du traitement automatisé des données à caractère personnel, adoptée le 28 janvier 1981 à Strasbourg, sur le considérant 14 de la présente décision, lequel, avec raison, renvoie en revanche à la décision-cadre relative à la protection des données à caractère personnel traitées dans le cadre de la coopération policière et judiciaire en matière pénale.
It would also be appropriate, in that respect, to align recital 10 of Framework Decision 2008/XX/GAI on the organisation and content of the exchange of information extracted from criminal records between Member States, which makes reference to the Council of Europe Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data, adopted in Strasbourg on 28 January 1981, with recital 14 of the present decision which, on the other hand, quite rightly makes reference to the framework decision on the protection of personal data processed in the framework of police and judicial cooperation in criminal matters. Your rapporteur has also thought fit to point out that the Member States need to adopt the above-mentioned framework decision on data protection without delay.
