Commends the Ombudsman for his work in promoting human rights, his openness towards vulnerable people and his cooperation with civil society organisations; deplores the fact that the Ombudsman’s annual and special reports have not been debated in the Parliament, and therefore cannot be published and are not officially acknowledged; urges the Government and the Parliament to improve cooperation with the office of the Ombudsman; deplores the fact that, so far, the Ombudsman has not regularly been informed or consulted by the Government in a timely manner on relevant draft legislation; notes with concern that the budget allocated to the Ombudsman’s office remains insufficient and has been further reduced; underlines the fact that the institution needs further financial and political support from both the Parliament and the Government in order to continue carrying out its duties; calls for a broad awareness campaign to highlight the role and importance of the institution;

13. demeure gravement préoccupé par l'inefficacité du système judiciaire, le risque d'ingérence politique dans les procédures judiciaires, la politisation des procédures de nomination, le caractère fragmenté de la procédure budgétaire dans le système judiciaire et le parquet et le risque de conflits d'intérêts au sein de l'appareil judiciaire; prie instamment les nouveaux dirigeants du pays d'entreprendre les réformes structurelles et institutionnelles portant notamment sur l'harmonisation des quatre systèmes juridiques différents; les invite à tenir compte des recommandations de la Commission, notamment sur une réforme institutionnelle du système judiciaire au niveau de l'État, y compris en ce qui concerne l'adoption d'une loi sur les tribunaux de Bosnie-Herzégovine; prie instamment le prochain Conseil des ministres d'adopter la nouvelle stratégie de réforme de la justice d'ores et déjà élaborée; renouvelle son soutien au bureau du Médiateur; note que le moratoire sur la peine capitale reste inscrit dans la Constitution de la République serbe de Bosnie et exhorte les autorités de la République serbe de Bosnie à abolir sans délai la peine de mort;

Remains seriously concerned about the inefficiency of the judicial system, the risk of political interference in court proceedings, the politicisation of appointment procedures, a fragmented judiciary and prosecution budgeting process and the risk of conflicts of interest in the judiciary; urges the new leaders of the country to undertake structural and institutional reforms addressing inter alia the harmonisation of the four different legal systems; invites them to address the Commission’s recommendations, such as institutional reform of the state-level judiciary, including on the adoption of a law on the courts of BiH; urges the incoming Council of Ministers to adopt the already prepared new Justice Reform Strategy; reiterates its support for the office of the Ombudsman; notes that a moratorium on capital punishment is still in place under the Constitution of the RS and urges the authorities of the RS to abolish the death penalty without further delay;
