In summation, in view of this analysis and of the constant practice of the Commission and the case law of the Court as regards the qualification of State participation in capital increases together with private investors, looked at on its own merits and independent of the other restructuring measures, the capital increase planned for mid-2007 amounts to a concomitant participation of public and private shareholders and therefore the participation of the State would not amount to State aid if the conditions set out above, relating to the fact that the capital increase will be underwritten by a commercial investment bank in a way ensuring effective concomitance of public and private subscription and to the ratio of public to private ownership, are complied with.

(82) The Commission considers that the attribution of the total residual value of the formation of the western mine waste tip and the access tracks as a loss due to the reduction of activity is excessive, since the possibility of abandoning the western side had been foreseen in the July 1994 plan and, to quote form the 1994 plan, "raising the bottom of the cutoff automatically makes available more than sufficient capacity for internal dumping, since the total volume of dead rock is decreased and it can be disposed of in a large cavity at the north end present in the base at a height of approximately 530 a.s.l".

3. Lorsqu'un État membre fait usage de la faculté prévue à l'article 62, premier alinéa, du règlement (CE) no 1782/2003 d'inclure une partie des montants correspondant aux primes aux produits laitiers et aux paiements supplémentaires dans le régime de paiement unique, il applique le pourcentage de réduction visé au paragraphe 1 du présent article aux montants correspondants inclus dans le régime de paiement unique durant l'année où il fait usage de cette faculté, compte tenu de l'augmentation des montants prévue à l'article 95, paragraphe 2, et à l'article 96, paragraphe 2, du règlement (CE) no 1782/2003.
3. Where a Member State makes use of the option, provided for in the first subparagraph of Article 62 of Regulation (EC) No 1782/2003, to include in part the amounts resulting from dairy premiums and additional payments in the single payment scheme, it shall apply the percentage of reduction referred to in paragraph 1 of this Article to the corresponding amounts included in the single payment scheme in the year in which it makes use of that option, taking into account the increase of the amounts provided for in Article 95 (2) and 96 (2) of Regulation (EC) No 1782/2003.
