22. For the purposes of subsections 11(1) and (2) of the Act, where a person in receipt of an annuity or annual allowance requests that it be paid otherwise than in equal monthly instalments, or where the payment of an annuity or annual allowance in equal monthly instalments is not practicable for administrative reasons, the Minister may direct, if such direction does not result in the payment of an aggregate amount greater than the aggregate amount of equal monthly instalments otherwise payable in accordance with the said subsections, that the annuity or annual allowance shall be paid in arrears

45. Lorsque le prestataire reçoit des prestations au titre d’une période et que, soit en application d’une sentence arbitrale ou d’un jugement d’un tribunal, soit pour toute autre raison, l’employeur ou une personne autre que l’employeur — notamment un syndic de faillite — se trouve par la suite tenu de lui verser une rémunération, notamment des dommages-intérêts pour congédiement abusif ou des montants réalisés provenant des biens d’un failli, au titre de la même période et lui verse effectivement la rémunération, ce prestataire est tenu de rembourser au receveur général à titre de remboursement d’un versement excédentaire de prestations les prestations qui n’auraient pas été payées si, au moment où elles l’ont été, la rémunération avait été ou devait être versée.
45. If a claimant receives benefits for a period and, under a labour arbitration award or court judgment, or for any other reason, an employer, a trustee in bankruptcy or any other person subsequently becomes liable to pay earnings, including damages for wrongful dismissal or proceeds realized from the property of a bankrupt, to the claimant for the same period and pays the earnings, the claimant shall pay to the Receiver General as repayment of an overpayment of benefits an amount equal to the benefits that would not have been paid if the earnings had been paid or payable at the time the benefits were paid.

(10) S’il s’agit d’un officier qui est mis hors cadre ou qui a obtenu un congé pour accepter un emploi dans la fonction publique du Canada ou dans les forces expéditionnaires du Canada ou dans toutes autres forces militaires levées au Canada pour le service en dehors du Canada et payées et maintenues par le gouvernement du Canada, ou qui a obtenu la permission de servir dans toutes pareilles forces, il lui est fait une retenue sur le pied de cinq pour cent par année du traitement ou de la solde, selon le cas, que reçoit cet officier dans la fonction publique ou à titre d’officier dans ces forces, et cette retenue fait partie du Fonds du revenu consolidé et est traitée, à tous égards, comme une retenue prévue par la présente loi; et nonobstant toute disposition de la présente loi, la pension accordée à un officier ainsi sorti du cadre, ou qui fait ainsi du service dans ces forces, est basée sur la moyenne annuelle du traitement et des allocations ou de la solde et des allocations, selon le cas, que, pendant les trois années immédiatement antérieures à sa retraite, cet officier recevait dudit gouvernement dans le service public ou dans ces forces, quel que soit celui de ces deux corps dans lequel il ait fait du service pendant ces trois années.
(10) In the case of an officer who has been seconded or given leave of absence for service in a position in the public service of Canada or in the Canadian Expeditionary Force or in any other military force raised in Canada for service outside Canada and paid and maintained by the Government of Canada, or who has been permitted to serve in any such force, deductions at the rate of five per cent per annum shall be made from the salary or pay, as the case may be, which such officer is receiving in the public service or as an officer in any such force, and those deductions shall form part of the Consolidated Revenue Fund and shall be treated in all respects as deductions under this Act; and, notwithstanding anything in this Act, the pension granted an officer thus seconded, or thus serving in any such force shall be based on the average annual salary and allowances or pay and allowances, as the case may be, that, during the three years immediately preceding his retirement, the said officer received from the said Government in the public service, or in such force in whichever he may have been serving during the said three years.
