In "national" situations, the contracting authorities, tenderers and contractors must comply, as a minimum standard, with all obligations relating to employment protection conditions and working conditions, including those deriving from collective and individual rights, that arise from applicable labour legislation, case law and/or collective agreements, provided that they are compatible with Community legislation and the rules and general principles of Community law, and in particular the principles of equal treatment and non-discrimination.
In "nationale situaties" moeten aanbestedende diensten, inschrijvers en aannemers als minimumnorm alle verplichtingen inzake arbeidsbescherming en arbeidsvoorwaarden naleven, inclusief die betreffende collectieve en individuele rechten, die voortvloeien uit de toepasselijke wetgeving op het gebied van arbeid, uit de jurisprudentie en/of uit collectieve overeenkomsten. Hierbij moet natuurlijk worden voldaan aan de voorwaarde dat deze verenigbaar zijn met de communautaire wetgeving en met de bepalingen en algemene beginselen van het Gemeenschapsrecht, en met name met de beginselen van gelijke behandeling en non-discriminatie.
